General conditions of online sales

These general conditions govern the completion and execution of contracts of sale and purchase concluded through the Gamastech Group's e-commerce website, which can be reached through the URLwww.reencle.eco (hereinafter, the "Site"). The means by which such contracts are concluded, qualifies them as Distance Contracts, pursuant to Part III, Title III, Chapter I, Section II of Legislative Decree No. 206 of September 6, 2005 (hereinafter, the "Consumer Code") to whose rules, where not derogated, specified or supplemented below, reference is made.

In particular:

1. Identity of the Professional

The supplier of the products and, therefore, the "professional" within the meaning of the referred standard, is Gamastech srl., based in Corso delle Province 116,95127 Catania, VAT 04696470873.

Essential characteristics of the product 2.

Each product offered for sale through the Site is clearly identified and, where necessary, its features and functionality are illustrated, in the relevant description sheets published on the Site.

3. Product Price.

The price of the product, expressed in Euros and including VAT, is indicated in the sheet accompanying the formulation of the order. The price does not include shipping costs, which, when provided, are indicated separately. The total amount due is indicated on the confirmation page before the final submission of the order.

4. Shipping charges

The shipping costs charged to the Customer, if any, are indicated in the order form and highlighted before the order is confirmed. For orders of less than € 50.00, shipping charges are normally € 6.00.

5. Methods of Payment.

The payment methods currently usable include the use of PayPal online credit cards, and bank transfer.

The credit cards accepted are those belonging to the Visa and Mastercard circuits while PayPal allows you to pay the amount by charging it directly to the credit card or prepaid card assigned, protecting the buyer's financial information.


If the Customer is an individual or a sole proprietor and the value of the purchase is between € 100.00 and € 1,500.00, there is also the possibility of using the mode of payment through the Scalapay platform - www.scalapay.com - and, following the instructions of the platform, divide the payment into three convenient installments.

The issuance of the purchase invoice follows the successful completion of the payment. The tax document is transmitted to the Customer in electronic format. A courtesy copy of the same is also transmitted by email, useful for the purpose of taking advantage of warranty service on the device.

6. Method of delivery of products

The products ordered are delivered to the address specified by the Customer in the order form, by means of courier appointed by Gamastech srl. Once the products have been delivered to the carrier, the Customer will receive an e-mail confirming the shipment. Deliveries are made from Monday to Friday, during normal office hours, excluding national holidays. Delivery is considered completed when the product is made available to the Customer at the address specified in the order form.

If the recipient of the products is absent at the specified address, the courier will leave a passing notice containing the necessary information to enable the Customer to schedule a new delivery. The courier will make a second delivery attempt 48 hours after the first, and if the Customer cannot be found again, the courier will leave a second notice of passage. In the event that the Customer does not contact the courier in the next 14 days to agree on a new delivery date, the products will return to the warehouses of Gamastech srl and the sales contract will be considered terminated due to a fact attributable to the Customer.

In this case Gamastech srl will refund the price paid, after deducting the charges incurred for the storage of the package at the local carrier and the subsequent return of the same, without the application of penalties or other recharges. The termination of the contract and the amount of the refund will be communicated via e-mail. The total amount of the refund will be credited to the means of payment used by the customer for the purchase.

The Customer is required to check the condition of the delivered product. In the event that the package shows obvious signs of tampering or alteration, the customer must refuse the delivery or, if he accepts it, he must take care of the affixing, on the transport document, of a description of the defect found and must still give prompt notice to the Customer Service of Gamastech srl.

7. Sales in free zones

Orders with delivery to Livigno or other free zones will still be charged VAT and no refund of the latter may be requested from Gamastech srl.

8. Right of withdrawal

Pursuant to art. 52 et seq. of the Consumer Code, the consumer customer (i.e. a natural person who buys goods for purposes not related to his professional activity, i.e. without indicating a VAT number) has the right to withdraw from the


purchase contract for any reason and without explanation, under the conditions set out below.

The withdrawal may relate to the entirety of the products purchased with the same order.

To exercise this right, the customer must send, within 14 days from the date of receipt of the goods, a communication, written and signed in his own hand, in which he unequivocally specifies his decision to withdraw from the contract. Exemplified:

This communication may be made by registered letter with acknowledgment of receipt or by telegram, certified e-mail, electronic mail or fax to be sent, within the aforementioned deadline, to:

Under penalty of forfeiture of the rights related to the still exercised withdrawal, within the same terms as above (14 days from receipt of the products), the Customer must provide, at his own expense, the return - meaning the delivery to the postal service or the courier in charge -- of the entirety of the products subject to withdrawal, to:

The substantial integrity of the goods to be returned is an essential condition for the exercise of the right of withdrawal. In particular, the return of products that are not in their original packaging and, for products contained within the package and sealed, of the appropriate warranty seal will not be considered suitable. Any ineligibility to return even a single product will result in the forfeiture of the Customer's right to withdraw from the contract in its entirety.

In the event that the Reencle system had been used, and its contents sealed in special packaging poured inside the machine, Article 59 Letter E and F of the Consumer Code will apply, which provides for the exclusion of the provisions of Articles 52 to 58 of the Consumer Code in the event that:

"Letter E the supply of sealed goods that are not suitable to be returned for hygienic reasons or reasons related to health protection and have been opened after delivery"

"Lett. F the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;"

Having ascertained the recurrence of the requirements for the validity of the withdrawal exercised by the Customer (timeliness of the communication and delivery of the products as well as the integrity of the latter) Gamastech srl will refund the full price paid, without additional charges, by crediting the same payment instrument used for the balance of the order.


9. Warranty Reencle® Eshop / Ecommerce

Gamastech S.r.l. (hereinafter referred to as Gamastech for brevity) guarantees that products purchased through its Internet Site are free from conformity defects for the terms, within the limits and in the manner set forth in Articles 128 et seq. of the Consumer Code, for customers who have purchased products as Consumers and in accordance with Articles 1487 et seq. of the Civil Code for business or professional customers. The warranty starts from the date of issuance of the sales invoice and has a duration of two years for private customers and one year for other types of customers.

To take advantage of the assistance, the customer, should write to info@gamastech.com describing the product that is assumed to be defective and indicating the defect found and the date of purchase, attaching a copy of the invoice. Verified the recurrence of the requirements to benefit from the warranty, Gamastech will provide the customer, through the same email address the necessary instructions for the shipment of the product, through its own courier at its own expense.

The customer agrees to pack the product free of any content. Products with the product compost inside will be sent back, at Customer's expense. Upon receipt of the product, Gamastech will verify the congruity between the date of purchase indicated on the invoice and the code characterizing the product; subsequently, the product will be subjected to technical inspections verifying the existence of the claimed defect and its qualification as a conformity defect in accordance with the standards referred to. Where confirmed the operation of the warranty, Gamastech will replace the defective product at its own expense by notifying the customer. In the event that one or the other verification gives a negative result, Gamastech will charge the customer for the charges incurred for the withdrawal of the product, the return of which will be subject to the payment of these costs in cash on delivery.

Excluded from the warranty are normal wear and tear of components such as gaskets, spatulas, air filters. The customer shall forfeit the warranty in case of tampering, repair or maintenance of the device by third parties not authorized by Gamastech, in case of use of spare parts or accessories that are not original Reencle or in case of use of the device with a voltage different from the prescribed one or in a manner that does not comply with what is indicated in the product specifications and in the ReenclePrime® user and maintenance manual as well as in case of incorrect assembly of accessories or spare parts.

10. Costs of using remote communication technology.

The use of a web connection for access to the Site's functionalities and for the completion of purchase contracts does not entail charges by Gamastech srl. and will be subject only to the pricing agreed upon between the Client and its internet service provider.

11. Duration of validity of the offer and price.

The products described on the Site are presumed to be available at the time the order is formulated and are offered for sale at the price published on the Site at the same time and highlighted in the summary generated when the shopping cart is closed.

Any changes that occur in the price of the products between the placing of the order and its fulfillment will not affect the Customer.

In the exceptional case in which a product ordered is not further available in stock, Gamastech srl will refrain from processing the order and from making any charge against the Customer, promptly providing, where already cashed, the return of the price paid by the same by crediting the means of payment used by the Customer for the purchase.

12. Warning

The purchase of products on the site Reencle.eco is reserved for a public of legal age and on the assumption of full possession of the capacity to act by customers. Gamastech srl will verify through the data provided at the time of registration, the age of majority on the part of the Customer and will not be responsible in the case of false statements made at the time of registration. Since the site can be reached only through an internet connection service, the responsibility for access to the site and consultation by a minor is the responsibility of the person who exercises parental authority or guardianship or otherwise who controls the minor's access to the internet.

13. WEEE

Legislative Decree 49/2014 on waste electrical and electronic equipment (WEEE), stipulates that household appliances should not be disposed of in the normal municipal solid waste stream.

Discarded appliances must be collected separately to optimize the recovery and recycling rate of their component materials, achieve significant energy savings, and prevent potential harm to human health and the environment. The crossed-out bin symbol is displayed on all products to remind them of their separate collection obligations. Consumers can drop off discarded household appliances at the public collection service, take them to designated municipal collection areas, or return them to retailers. All major manufacturers of household appliances are active in establishing and operating collection and disposal systems for discarded appliances.

Definitions

EEE: Electrical and Electronic Equipment

WEEE: Waste Electrical and Electronic Equipment

In compliance with the provisions of Ministerial Decree 65/2010 art. 1 paragraph 1, customers are informed that when supplying a new electrical or electronic equipment (defined EEE) intended for a household, Gamastech srl ensures the free collection of the old electrical or electronic equipment (defined WEEE) having the same functionality.

It should be noted that free take-back of WEEE is provided that it is derived from a household, is of an equivalent type, and has performed the same functions as the new equipment purchased.

The free WEEE take-back will take place at the same time as the delivery of the new product. Exclusions:

  • there is no free take-back against a purchase of items not belonging to the EEE category, the details of which can be found in Annex 1 and 2 of Legislative Decree 49/2014;
  • no pickup of WEEE involving contamination or safety risks by pickup personnel.

14. Validity of the General Conditions of Sale - Amendments

Gamastech srl reserves the right to make changes or additions to these

General Terms and Conditions of Sale; such amendments and additions shall not affect contracts already concluded and in progress.
